Terms and Conditions
1. Introduction
These Terms and Conditions (“Terms”) govern the manufacture, delivery, installation and supply of bespoke softwood and hardwood gates and garage doors (including treatment, ironmongery, glazing and beading) , (“Products”) by A34 Timber Gates & Garage Doors Ltd (“Company”), located at Unit 2, Rear Of Buxtons, Coppice Farm, A34, Penkridge, Staffordshire, ST19 5RP . By placing an order with the Company, the customer (“Customer”) agrees to these Terms.
2. Product Specifications
- Bespoke Products: All products are made to order according to the specifications provided by the Customer.
- Materials: The Company uses natural softwood and hardwood, which may exhibit variations in colour, grain, and texture.
- Natural Characteristics: Wood is a natural product and may move, warp, or crack due to changes in temperature and humidity. These natural movements are not considered defects but inherent characteristics of wood.
3. Orders and Acceptance
- Quotations: All quotations provided by the Company are valid for 30 days from the date of issue unless stated otherwise..
- Order Confirmation: Orders are confirmed upon receipt of a written purchase order from the Customer and a deposit of 40% of the total order value.
- Changes to Orders: Any changes to the order must be made in writing and may incur additional charges.
4. Payment Terms
- Deposit: A deposit of 40% of the total order value is required to confirm the order.
- Balance: The remaining balance is due upon completion of the installation. Payment is required one day prior to arranged delivery date.
- Late Payments: Failure to make timely payments constitutes a breach of these Terms and Conditions and may result in the suspension of services or legal action to recover the outstanding amount.
5. Title and Ownership
Ownership of all Products supplied by the Company remains with A34 Timber Gates & Garage Doors Ltd until full payment has been received from the Customer. This includes the deposit and remaining balance.
In the event of non-payment or failure to meet agreed payment terms, the Company reserves the right to recover any Products for which payment has not been made. The Customer agrees to grant the Company, or its agents, reasonable access to the property where the Products are installed or stored in order to recover such items, if necessary and lawful to do so.
Until full payment is received, the Customer must not sell, alter, or dispose of the Products. Risk of damage or loss passes to the Customer upon delivery or installation; however, legal title shall not transfer until payment is complete.
This clause does not affect the Company’s right to pursue legal action for recovery of any unpaid amounts or additional costs associated with recovering goods.
6. Deposit Policy
All deposits paid are strictly non-refundable. The deposit serves to secure the booking of the job and covers the cost of materials and preparatory arrangements. Once confirmed, additional fees may apply in the event of a cancellation. (See section 13, below).
Bespoke Products may require additional deposits, which also fall under this deposit policy.
7. Delivery and Installation
- Delivery: The Company will make every effort to deliver the Products on the agreed date. However, delivery dates are estimates and not guaranteed.
- Installation: The Company will install the Products at the Customer’s premises, provided the site is prepared according to the Company’s specifications and that the weather is suitable to do so.
- Access: The Customer must ensure that there is adequate access to the installation site. Any delays caused by inadequate access may incur additional charges.
- Completion and Inspection: Upon completion of installation or delivery, the Customer must inspect the Products to ensure they are satisfied with the goods. Any concerns or defects should be reported to the Company immediately. By accepting the Products without immediate notification of issues, the Customer acknowledges that the goods meet the agreed specifications and are free from visible defects.
8. Painting and Treatment
- Painting: The Company offers painting services using high-quality paints and finishes. However, the final colour may vary slightly due to the natural characteristics of wood.
- Treatment: Wood treatments are applied to enhance durability and appearance. The Customer must follow the Company’s maintenance guidelines to ensure the longevity of the treatment.
9. Glazing, Beading, and Ironmongery
- Glazing: A34 Gates and Garage Doors supplies and fits glazing as per the Customer’s specifications. Any specific requirements must be communicated at the time of order. Glazing will not be fitted for delivered items, but packed separately.
- Beading: Beading is supplied and fitted to complement the overall design of the Products.
- Ironmongery: Ironmongery, including locks, handles, and hinges, is supplied and fitted according to the Customer’s choice.
10. Warranty and Liability
- Warranty: The Company provides a 3 month warranty on all Products against defects in materials and workmanship.
- Exclusions: The warranty does not cover natural movements, warping, or cracking of wood, damage caused by improper maintenance, misuse, or unauthorized alterations.
- Liability: The Company’s liability is limited to the repair or replacement of defective Products. The Company is not liable for any indirect or consequential losses.
11. Maintenance
- Customer Responsibility: The maintenance and upkeep of all products supplied by the Company, including gates, garage doors, glazing, beading, and ironmongery, are the sole responsibility of the Customer.
- Ongoing Care: The Customer must perform regular maintenance to preserve the condition, functionality, and appearance of the products. This includes cleaning, painting, treating, and inspecting the products as necessary.
- Guidelines: The Company will provide general maintenance guidelines upon installation or delivery. It is the Customer’s responsibility to follow these guidelines to ensure the longevity and performance of the products.
- Regular Inspections: The Customer should conduct regular inspections of the products to identify any signs of wear, damage, or necessary repairs.
- Professional Services: For complex maintenance tasks or repairs, the Customer is advised to seek professional services to ensure the work is performed correctly and safely.
12. Wood Movement and Environmental Impact
- Natural Movement of Wood: Wood is a natural material and inherently subject to movement, which includes expansion, contraction, warping, and cracking when exposed to varying weather conditions such as temperature fluctuations, humidity, and precipitation.
- Environmental Impact: External wooden products, including gates and garage doors, are continuously exposed to the elements. Direct sunlight, rain, wind, and extreme temperatures can accelerate the natural aging and movement of wood.
- Impact of Surrounding Structures: The stability and alignment of gates and garage doors can be affected by the condition of surrounding brickwork and masonry. Crumbling or deteriorating brickwork can cause misalignment, sagging, or additional stress on the fixtures.
- Customer Responsibility: It is the Customer’s responsibility to ensure that the surrounding structures, such as walls and pillars, are in good condition and capable of supporting the installed products.
13. Product Settling and Adjustment
- Natural Settling: Due to the inherent properties of wood and the mechanical nature of doors and gates, it is expected that these products may drop, settle, or shift over time as a result of regular use.
- Customer Responsibility for Adjustments: The Customer is responsible for any adjustments required after the initial installation to correct minor settling, dropping, or shifting of the doors and gates.
- Exclusion from Warranty: The Company’s warranty does not cover adjustments or repairs related to the natural settling, dropping, or shifting of doors and gates due to regular use.
- Professional Adjustments: While the Customer can perform minor adjustments, the Company recommends seeking professional assistance for more complex adjustments to ensure proper alignment and functionality.
- Disclaimer: The Company shall not be held liable for any settling, dropping, or shifting of doors and gates due to natural wear and tear or external factors beyond the Company’s control.
14. Cancellation and Returns
- Cancellation: Orders can be cancelled within 14 days of confirmation, subject to a cancellation fee of 40% of the order value. Deposits are non refundable, as per term 5, shown above.
- Returns: Products that are bespoke made, returns are not accepted unless there is a defect covered by the warranty.
15. Changes to Terms and Conditions
- Modification of Terms: The Company reserves the right to modify these Terms and Conditions at any time. Any changes will be posted on the Company’s website and will take effect immediately upon posting.
- Notification: The Company will notify existing Customers of significant changes to these Terms via email or other means of communication. It is the Customer’s responsibility to ensure that their contact information is up to date.
- Binding Effect: By continuing to use the Company’s services or website after changes to these Terms have been posted, the Customer agrees to be bound by the revised Terms. Existing orders will also be subject to the revised Terms, except where specific changes are expressly stated not to apply to existing orders.
16. Governing Law
These Terms and any disputes arising from them are governed by the laws of England and Wales. The parties submit to the exclusive jurisdiction of the courts of England and Wales.
17. Inspection Guidelines
If you zoom in using a phone or iPhone camera, any minor details or natural wood characteristics revealed are not considered imperfections or manufacturing errors. This applies to all visual assessments in response to customer queries.
For reference, industry standards generally assess visible imperfections from a normal viewing distance (approximately 1-2 meters). Closer inspection with enhanced magnification (e.g., zooming in digitally) does not reflect the product’s quality under regular use conditions
